ABC News will seek to dismiss case today

ABC News is expected to file a motion in federal court today for the judge to dismiss the lawsuit brought against it by Beef Products Inc.

The network indicated in a motion filed last Friday that it would be presenting a lengthy response to BPI’s original complaint, and asked for permission to file a brief that exceeded the usual limits. In that motion, ABC said it would file a motion to have the case dismissed on Oct. 31.

“This motion will address the substance of all of the claims asserted in the Complaint. Given the length of the Complaint and the number of counts contained therein, additional space is required to set forth all of the grounds for dismissal,” ABC said in its court documents.

BPI’s original complaint runs to 257 pages, with 107 exhibits that add several hundred more pages to the filing.

BPI has a request before the court to have the case returned to the state court system, where it originally was filed. If the case is moved back to state court from federal court, then ABC’s motion to dismiss will be decided by the state court in accordance with its rules.
