A North Carolina Superior Court judge has agreed to review the lawsuit filed against the commissioners of Nash County, N.C., because they allegedly bought land for a planned Sanderson Farms poultry plant without benefit of a public hearing, potentially a violation of state law, according to a report in the Wilson (N.C.) Daily Times.

The case was filed by two local farmers in September. They are asking the court for a preliminary injunction against transfer of the property from Nash County to Sanderson Farms until the case is decided, the newspaper said.

The case is due to be reviewed Monday morning.
