Perdue will keep defending its labels against HSUS complaint

Perdue Farms will continue to defend itself against an activist group charge that some of its labels are misleading.

Yesterday, a federal judge denied a motion by Perdue Farms to dismiss a lawsuit by The Humane Society of the United States alleging that one of the company’s brands misleads consumers about the humane treatment of chickens.

“We stand by the USDA Process Verified Program Humanely Raised claim and plan to vigorously defend ourselves,” Perdue spokeswoman Julie DeYoung told Meatingplace in an email.

“This HSUS’ third attempt at this case, now very narrowly confined to label claims on Harvestland brand products. Their earlier efforts were dismissed after it was disclosed that the products they are suing about weren’t even sold in New Jersey, where the case is being brought. The judge gave them an opening to come back with a more specific complaint and that is what they have now done,” she explained.

Products carrying the Humanely Raised seal are verified by the USDA to come from birds raised in accordance with the Perdue Farms Poultry Welfare Program.

“Our Humanely Raised and Raised Cage Free PVP programs exceed our competition’s and the National Chicken Council’s standards in multiple areas. Perdue is the first poultry company with third-party audits by the USDA to ensure the humane treatment of our birds,” DeYoung said. “We look forward to putting these baseless allegations to rest, yet again.”
