"Right-to-farm" legislation moving through General Assembly

Bills to strengthen NC's "right-to-farm" law are moving through the General Assembly.

Current law says that if a farm has been in operation for one year, it cannot be a nuisance. Senate Bill 509 and House Bill 614 - The Agriculture and Forestry Act - would expand that law to also include a farm that has been in operation for a year even if one of the following has happened:

*The operation has a change in ownership or size;
*Non-permanent cessation or interruption of farming;
*Employment of a new technology; or
*A change in the type of agricultural or forestry produced.

If passed, the bill would also award attorney's fees to a farmer who has won a civil action where the agricultural operation was alleged to be a nuisance.
