Court rules for poultry farmer in water case

A federal judge ruled in favor of a West Virginia poultry farmer in a dispute over whether Clean Water Act NPDES permits were needed for farmyard runoff. In Alt v. EPA, the district court ruled that manure and litter runoff from a farmyard during a precipitation event is “an agricultural stormwater discharge and therefore not a point source discharge, thereby rendering it exempt from the NPDES permit requirement of the [CWA].”
