Ethanol, ag groups sue EPA over fuel standards

Seven trade associations have filed a federal court appeal seeking a review of the Environmental Protection Agency's (EPA) Renewable Fuel Standard (RFS) requirements that were finalized in November, according to media reports.


The groups are challenging EPA’s authority to waive biofuel volume mandates set by a 2007 law.


The lawsuit was filed last week by the Biotechnology Innovation Organization, Americans for Clean Energy, American Coalition for Ethanol, Growth Energy, National Corn Growers Association, National Sorghum Producers and the Renewable Fuels Association.


Overall, the final RFS volumes represent a cut of more than 2 billion gallons of renewable fuels from the 2007 statute, according to the report by DTN/The Progressive Farmer.


But the levels set in November were above those initially proposed by EPA, sparking criticism from the National Chicken Council, which argued that corn diverted from feed and food would increase costs for poultry and livestock producers.
