WOTUS challenge to be decided in Cincinnati

A challenge by several states to the Environmental Protection Agency’s waters of the U.S. (WOTUS) rule will proceed in the Sixth Circuit Court of Appeals in Cincinnati, after the Eleventh Circuit Court in Atlanta deferred the case to avoid duplicating judicial resources, USAgNet reported.

WOTUS would expand the Environmental Protection Agency’s jurisdiction under the Clean Water Act to include bodies of water such as streams that farmers use for drainage and irrigation and adjacent lands. Implementation of the rule was stayed by the Sixth Circuit Court last fall.

The Sixth Circuit has already ruled it has jurisdiction in the case and has been preparing to hear it. Attorneys general from 10 states are the plaintiffs in the appellate court case, according to the article.
