Course Information

Presenting cases from the comfort of your home can present unique challenges that even experienced prosecutors haven’t faced before the COVID Crisis. While the technology is not new, presenting cases virtually is a new experience for most lawyers, witnesses and judges. Join us to learn cost-effective techniques to maximize your presentations. Clarity and credibility are even more important in a virtual world. During the presentation, you will learn everything from what equipment to use to how to introduce and annotate exhibits. To persuade, you need to be both heard and seen. ZOOM has many features that lawyers who aren’t tech savvy can easily manage. Learn how to markup exhibits on ZOOM and import exhibits from PowerPoint, Trial Director or Sanctions. The goal of the program is to provide simple, practical applications to work with complex technology.

During the presentation, we will discuss:

  1. Camera options: cellphone, computer, webcam, DSLR, or camcorders.
  2. Use of microphones: built-in, headphones, lavalier, or a boom mic. 
  3. Limitations of your WiFi connection and your computer speed?
  4. Lighting to make you look good, or bad.
  5. Best camera angle, elevation and field of view.
  6. Importance of your background.
  7. Is a greenscreen worth the effort? 
  8. Impact of nonverbal communication.
  9. Permissible hearsay under Ricker to avoid violating the Confrontation Clause.
  10. While the program will focus on ZOOM applications, the principles apply equally to other programs such as Skype, Teams, Facetime, Ring, GoToMeeting, Google Meet, etc.

District Attorney Mark Powell is a Board-Certified Criminal Trial Specialist with his LLM in Trial Advocacy. Over the last 20 years, he has taught trial persuasion across Pennsylvania and in Washington, D.C. However, most of what you will hear is based on his experience as an amateur photographer who began using 35-millimeter film and developing negatives in a darkroom. Despite advancing to DSLR cameras with fast, low-light lenses, he readily admits that knowing how to use a camera is more important than the cost of the equipment. Lackawanna County is forging through the COVID shutdown by conducting preliminary hearings for both incarcerated and non-incarcerated defendants, contempt hearings, sentencings and ARDs all virtually. Come learn what’s working and what’s not and, most importantly, how you can be an effective prosecutor in our “new normal” courtroom.
