Domestic Violence and Sexual Battery in the LGBTQ+ Community
Speaker
Teresa A. Hall, Esquire Division Chief-Felony Division C State Attorney’s Office of the Thirteenth Judicial Circuit, Hillsborough County, Florida Education Chair for the Florida Prosecuting Attorney’s Association Adjunct Faculty-Stetson University-College of Law
Course Information
Domestic violence and sexual abuse happens to all walks of life. Perpetrators do not discriminate among gender, sexual orientation, race or other factors that make us who we are. The prosecutor will encounter victims that fit in the LGBTQ+ spectrum. Although our criminal statutes are the same for domestic violence or sexual battery regardless of whether the victim is within the LGBTQ+ spectrum, the victim isn’t. During this presentation we will discuss the unique aspects of dealing with a victim that identifies as LGBTQ+, how to develop a relationship with your victim, to provide services when needed and how to deal with the victim’s potential reluctance to participate in the prosecution. We will take the basics that we have learned in domestic violence and sexual abuse prosecution and apply it to the unique facts that you will be given. The use of hate crime legislation will briefly be discussed, as well as the use of evidence based prosecution.
