SB 1014 English language learners; instruction; budgeting

This bill alters the English Language Learner (ELL) Program, lowering the minimum amount of time ELL students are required to be in English language development each day. The State Board of Education (SBE) must adopt research-based models for structured English immersion that include a minimum amount of English language development as follows:

=         For students in grades K-5

o   120 minutes per day OR

o   600 minutes per week OR

o   360 hours per school year.

=         For students in grades 6-12

o   100 minutes per day OR

o   500 minutes per week OR

o   300 hours per school year.

=         The SBE must adopt alternative research-based English instruction models, and allow districts and charters to submit SEI and alternative English instructions models for them to approve.

=         Requires SBE, after soliciting input from experienced educators, to adopt rules to establish a framework for evaluating research-based models submitted for approval.

=         Directs SBE to ensure adopted models meet the following criteria:

o   Provide coherent instruction aligned with English language proficiency standards;

o   Include oral and written language instruction, including structured opportunities to develop these skills;

o   Include access to complex language content through grade-level textbooks with appropriate supports;

o   Include parental engagement strategies.

=         Removes federal title III and other federal offsets to conform with current practice.

=         Specifies a pupil who is designated as an ELL student is not prohibited from being concurrently enrolled in an SEI and alternative English instruction model.

=         States that each school district governing board must select and implement 1 or more SEI and approved alternative English instruction models on a school-by-school basis.

=         Eliminates the provision that ELL support funds may not be distributed for more than 2 years to the same person.

=         Requires the department of education to provide annual report and present a summary on ELL programs to the SBE, Auditor General, Governor, President of the Senate and Speaker of the House- as well as provide a copy of the report to the Secretary of State.

=         Directs the Board to include the following in their report

o   Descriptions of the adopted model of ELL instruction, number of schools currently implementing them, and the number of students enrolled in each.

o   The length of time students are classified as ELL and their academic performance on the statewide assessment for the 2 years after they achieve proficiency.

o   Summary of demonstrated success of ELL students achieving English proficiency.

=         Removes the random sample of 300 ELL students each month from the department’s monitoring duties. 

=         Requires the Office of the Auditor General to conduct an analysis on the effectiveness of all models adopted by SBE and identify the most effective.
