Staff Analysis of the Legislation

SUMMARY:  LC 29 6281  Deals with provisions related to prohibitions against carrying firearms and other weapons within a school safety zone, at school functions, and transport of students.  Attemps to clarify issues related to the passage of HB 60 and HB 826 last session.

PROVISIONS:

  • it would be a criminal offense only to have firearms and explosives (except fireworks) in a school safety zone (16-11-127.1)
  • defines firearm as a handgun, rifle, shotgun, pistol, revolver or other weapon which can be converted to expel a projectile by the action of an explosive or electrical charge 
  • prohibition of such items listed above is also prohibited on motor vehicles used to transport students (not privately owned vehicles) and transit vehicles use for transporting students and/or employee to or from school or school activities.
  • school safety zone is defined as in or on any real property or building owned by or leased to a school or postsecondary institution
  • defines school functions as a public or private educational program or institution instructing children at any level pre-K through 12th grade
  • amends 16-11-130.1 to define "weapon" as a firearm for the purpose of personnel authorized to carry 
  • Amends 16-11-173(f) to define "weapon" in this section as any pistol, revolver, or any weapon designed or intended to propel a missile of any kind, or any dirk, bowie knife, switchblade knife, ballistic knife, any knife having a blade of two or more inches, straight edge razor, razor blade, spring stick, knuckles, bat, bludgeon, club, flailing instrument, disc with points or blades, stun gun or taser.

EFFECTIVE DATE:  Upon approval by the General Assembly and Governor.
