Under current law, festivals, fairs and events held by nonprofit organizations are not considered "food service establishments" subject to regulation by the department of health when the county issues a temporary permit to the nonprofit for food sales and service. This legislation allows the county to delegate the authority to issue such permits to the county board of health.

This legislation exempts certain nonprofit organizations from the board of health's food service establishment requirements. The exemption would apply to qualified nonprofit organizations that operate food banks; that provide on-site feeding programs for free distribution of food to combat poverty and hunger; that provide food to houses or residential structures where seriously ill or injured children and their families are provided temporary accommodations near the hospital where the child receives treatment, so long as food is prepared, served, transported or stored by volunteer personnel.

This legislation allows the Revenue Commissioner to license farm wineries to make distilled spirits and fortified wines, as well as to have a tasting room located on the property of the farm or the property adjacent to the farm.
