This legislation changes the method that 9-1-1 fees are assessed on prepaid wireless cellular phones and service, and sets forth a method for distribution of the fees to local governments. The bill provides for a 75 cent fee on each retail purchase of a wireless telephone or purchase of service. The fee will be remitted by the retailer along with sales tax to the Department of Revenue. Fees will be distributed to 9-1-1 centers based on the population of the Public Safety Answering Point. For a full overview and summary of the legislation click here.

The language from HB 304 was added to this bill by the Senate Committee. HB 304 provides clean up language in O.C.G.AS 46-5-124.1 to require all suppliers to register to ensure that telephone service connections are assessed a 9-1-1 fee.

The language from SB 113 was added in the Senate.  SB 113 deals with contract between local governments and vendors.

HB 872 is a compromise bill which includes provisions from the Senate verison SB 321.  This legislation requires secondary metal recyclers to obtain a permit from the sheriff every year. The sheriff is required to keep a record of all permits, the date of issuance, as well as the name and address of the permit holder. All of the information must be entered into a statewide electronic database created by the GBI. The sheriff may impose a reasonable permit fee. This legislation requires that all Voice Over Internet Protocol (VOIP) service supplier register as a provider with GEMA for purposes of paying required 911 fees.  The bill provides a definition of prepaid cellular service to all forms of prepaid service, and clarifies that prepaid cellular service providers are not eligible to bill local government for cost recovery.

HB 1065 makes numerous changes to tax payment and reporting provisions to the state for alcoholic beverages. Of importance to local governments, it stipulates that local alcohol taxes on distilled spirits "shall be paid on or before the tenth day of the month following the calendar month in which distilled spirits are sold."

This bill allows manufacturers of distilled spirits (made of perishable fruits) to provide educational and promotional tours of their distilleries.  It also authorizes, with proper licensure, the manufacture of distilled spirits from products other than perishable fruits to be licensed in the state.  The latter distilleries can also provide educational and promotional tours of their operations.

SB 408 amends Georgia's call-before-you-dig law and allows counties to replace existing traffic control devices without having to call, wait and have all utilities locate and designate their underground utilities.  For example, if a stop sign is knocked down and has to be replaced, it could pose a public safety hazard having to wait for all utilities to be located by their respective owners.  The replacement would have to be within a radius of 18 inches from the device's previous location and to a depth that does not exceed 30 inches below the existing grade.
