This legislation allows the tax commissioner some discretion when valuing a used vehicle that sells for less than the value in the Department of Revenue Assessment Manual. Upon the request of the vehicle owner and supporting documentation, the tax commissioner could consider mileage, condition, the bill of sale and values from a reputable pricing guide to determine a value that more closely reflects the current condition of the vehicle. This discretion may help address the taxpayers concerns with the DOR value and prevent the owner from making an appeal to the Board of Assessors.
 
This legislation changes the way interstate commercial trucks that register under the International Registration Program (IRP) are taxed by the local governments.  Currently they are required to pay a proration of the ad valorem taxes due based upon the percent of total miles driven in Georgia.  Under the new system they will pay a local alternative ad valorem tax based upon a proration of miles driven in Georgia to the Department of Revenue (DOR).  The DOR will then distribute the local revenues back to the counties, schools and cities based upon their pro rata share of total ad valorem taxes collected statewide.  The industry estimates that the new system will increase local revenues from $9 million to just under $17 million per year.  IRP truck owners will also be authorized to pay the local ad valorem taxes due on their trailers to DOR or the county.  Any local trailer taxes collected by DOR will be distributed back to the local governments where the trailers are domiciled.

This legislation requires drivers to leave an empty lane between their vehicle and the vehicle of a sanitation worker flashing yellow, amber, white or red lights when passing. If such a lane change is not possible, legal or safe, then the driver must reduce their vehicle speed and be prepared to stop. This only applies to sanitation workers collecting or transporting solid waste and recyclable as authorized by a county or city.

This legislation clarifies the definition of a personal transportation vehicle by merging motorized carts, golf cars, and golf carts into one definition. It also provides minimum requirements for who can operate a PTV, along with minimum safety requirements to be installed on the PTV for operation in the evening.

This legislation authorizes local governments, at their option, to adopt an ordinance allowing for the operation of PTVs on certain roadways and designated pathways subject to certain requirements established by the local government. It gives local governments the option to adopt a transportation plan to address minimum requirements for operating a PTV on the roadways, as well as construction and use of designated pathways.

This legislation allows GDOT to issue an annual port proximate permit for a fee of $500 to allow trucks with weights up to 105,000 lbs on the National Highway System within a 20 mile radius of a port facility or designated facility.

This legislation extends the sunset for the driver's education fine add-on until June 30, 2016; however, it reduces the fine add-on from 5 percent to 1.5 percent.  Furthermore, it requires that the Georgia Driver's Education Commission issue an annual report to the General Assembly listing how much in fines were raised each year (around $10 million of recent) and whether or not that money has been used for driver's education... or merely dumped into the state's general fund to be used for other purposes.  Note that of the $80 million raised since 2005, only $7 million has gone toward driver's education.
