HB 0274 NeutralYard Trimmings in Landfills and Extend Solid Waste Trust Fund Nix,Randy 69th
5/11/2011 House Date Signed by Governor NR&E NR&E -
Nat. Res. & the Environment Solid Waste Todd Edwards

HB 274 allows yard trimmings to be disposed of in a lined landfill (MSW) if it has a permitted gas collection system in operation that reuses the gas for electrical power generation, industrial end use or other beneficial use promoting renewable energy goals.

Additionally, this bill reauthorizes the scrap tire fee (Solid Waste Trust Fund) for three more years, allowing the General Assembly to continue redirecting this money to the state's general fund to balance the budget.

HB 0684 NeutralLocals to Have Notice of State Park Closings Buckner,Debbie 130th
3/29/2012 Senate Passed/Adopted GF&P NR&E -
General County Government Nat. Res. & the Environment Todd Edwards

Under this bill, whenever the Department of Natural Resources is considering closing or reducing (by 50 percent or more) the hours of operation of a state park or recreational area, they are required to provide at least 90 days notice to the city or county in which the park or recreational area is located.  The idea being that, with due notice, the local government would have ample time to decide whether it wanted to take over the control, operation and/or management responsibilities.

HB 1102 NeutralHazardous Sites, Septage Land Disposal Permitting and Sewer Bill Collection Smith,Lynn 70th
5/1/2012 House Date Signed by Governor SCSBDJ NR&E -
Economic Development Nat. Res. & the Environment Todd Edwards
A multi-faceted bill, HB 1102 originally established a 30-day grace period for liability limitation for a purchaser of a hazardous site. It was amended late in the session to also address:

Septage Land Disposal Permitting Delay - providing a two-year extension for septage land disposal sites to have to obtain EPD permitting under the standing DNR septage disposal rules (compromise language ACCG agreed to).

Calculating and Paying Sewer Bills - requiring any privately-owned public water supplier who is not providing sewer service to a location, but the sewer service is provided by a local government, to inform the public sewer provider of the water used by each customer (to help calculate appropriate sewer bills).  Furthermore, if the customer is not paying his or her public sewer bill, the private water provider must discontinue water service within 5 days of being informed by sewer provider of non-service (to help enforce sewer bill payment).

SB 0110 NeutralSeptage Land Application Sites - Delay EPD permitting for two years Murphy,Jack 27th
3/29/2012 Senate Conference Committee Appointed NR&E NR&E -
Nat. Res. & the Environment Todd Edwards
A few years back, the General Assembly directed the state Environmental Protection Division to promulgate regulations and begin permitting septage land disposal application sites by July 1, 2012.  As these rules came out, several small septage haulers are lamenting that these new regulations will put them out of business.  Accordingly, a House Committee Substitute to SB 110 delays the EPD permitting process for two years so that the Division can meet with stakeholders to consider relaxing some of the regulations thus promulgated.

SB 122 authorizes local governments and the state (at their discretion) to contract with private firms to procure permits and licenses, plan, finance, build, acquire, operate and maintain a water reservoir, facility or system -- acting in concert with GEFA's Water Supply Division if they wish. The local government may pay the firm with the user fees, purchase payments and other revenue for these services. This bill also establishes a process that counties can partner with other governments to enter into agreements up to 50 years with a private partner. Unlike proposals from previous sessions, SB 122 ensures that local governments participate in all aspects of the process.

SB 0157 SupportSolid Waste Management Reporting and Plan Updates - Make Optional Jeffares,Rick 17th
5/11/2011 Senate Date Signed by Governor NR&E NR&E -
Nat. Res. & the Environment Todd Edwards

SB 157 makes local Solid Waste Management Plans (SWMP) updates optional for counties and cities and removes the requirement of having to complete an annual, duplicative solid waste report. Counties without zoning and land use ordinances may, however, wish to complete these plans and adopt them by local ordinance as the plans will maintain their ability to effectively govern the sitting of solid waste facilities within the community.

Amendments to the bill now require public notice any time a local SWMP is updated and require both public and private landfills to annually report to DCA the amount of waste disposed, the landfill's remaining capacity, recycling and composting activities, and any other information as may be required by DCA.

SB 0269 SupportCompliance with Water Pollution Rules Jeffares,Rick 17th
2/3/2012 Senate Read Second Time -NR&E -
Nat. Res. & the Environment Sewer/Septage Todd Edwards Water Quality

This bill revises procedures for local governments to come into compliance with EPD water/wastewater pollution rules; making it clear that the EPD Director may notify the violator in writing of the opportunity to perform voluntary remedial action via consent order and authorizing the Director to require a bond or letter of credit to ensure compliance instead of a traditional fine. If a consent order to comply is violated, the local government may have its bond or letter of credit forfeited with that money being deposited into a new fund at the Georgia Environmental Finance Authority to help pay for these compliance projects.

SB 319 prohibits anyone except for law enforcement and the Department of Natural Resources to have a boat on the waters of any park, historic site or recreational area if signs are posted by the Department designating the prohibition.

The bill was amended late in the session to amend the State's Marshlands Protection Act by redefining what "live aboard" vessels are and to expand, from 30 to 90 days, the amount of time folks can occupy said vessels in a calendar year.
SB 0369 SupportExtend the Life of the Georgia Geospatial Advisory Council Carter,Earl Buddy 1st
3/19/2012 House Committee Favorably Reported NR&E NR&E -
Nat. Res. & the Environment Todd Edwards

This bill extends (from June 30, 2012 to June 30, 2015) the life of the Georgia Geospatial Advisory Council (GGAC). ACCG was a strong advocate of establishing the GGAC, which has audited Georgia's geospatial capabilities at the local, regional and state level. It also recommends how to best utilize these capabilities to meet FEMA notification requirements, achieve governmental data interoperability, and enhance the delivery of services to Georgia citizens.

SB 0374 NeutralExempt Tennessee River Withdrawals from IBT Restrictions Mullis,Jeff 53rd
2/29/2012 Senate Read Second Time -NR&E -
Nat. Res. & the Environment Todd Edwards Water Quantity

Current state law prohibits the interbasin transfer (IBT) of water from a basin outside the Metropolitan North Georgia Water Planning District to within. SB 374 overrides this, allowing surface water withdrawal from the Tennessee River Basin (in Chickamauga Valley & Lookout Mtn.) to be exempt from that restriction.  It also does away with other IBT regulations in Georgia as far as withdrawal from the Tennessee River Basin is concerned.

SB 0401 NeutralCogeneration and Distributed Generation Act Carter,Earl Buddy 1st
2/8/2012 Senate Read and Referred -NR&E -
Nat. Res. & the Environment Todd Edwards

SB 401 amends the Georgia Cogeneration and Distributed Generation Act of 2001 (the Act) to provide a greater range of financing tools, including power purchase agreements, for distributed generation projects. (Distributed generation is electric power provided by customers on their premises primarily to meet their on-site needs.)  It also expands Georgia’s distributed generation statute to add biomass, municipal solid waste, landfill gas, and hydropower as eligible resources and to remove existing caps on the size of individual projects.

This applies to when commercial companies own and operate customer-sited solar systems and lease solar equipment or sell solar electricity generated on-site to local governments at or below current utility costs.

SB 0415 NeutralEPD Wastewater Permits: Only Need Before Operating Plant Jeffares,Rick 17th
2/15/2012 Senate Read and Referred -NR&E -
Nat. Res. & the Environment Sewer/Septage Todd Edwards Water Quantity
Current state law requires that counties and cities have to obtain an EPD permit before they construct, install or modify wastewater treatment facilities.  This bill only requires that the EPD permit be obtained prior to "operating" a wastewater treatment facility, effectively allowing the construction to begin prior to the permit being in hand.
