This legislation, with certain exceptions, prohibits all employers, including counties, from requesting, requiring or obtaining a credit check from a current or potential employee. Credit checks may be used if the employee or potential employee is being evaluated because the position is a managerial position involving setting the direction or control of the "business," involves access to customers', employees' or the county's financial information (other than the information routinely provided in a retail transaction), or involves fiduciary responsibility (including the authority to issue payments, transfer money or enter into contracts).  Violation of this law is a misdemeanor punishable by a fine between $500 to $2,500.

This legislation allows fulltime associate probate court judges to serve as a judge advocate general or other military role in a military reserve.  Under current law, full time associate probate judges are not allowed to practice law outside of his or her role as judge.

This legislation mandates that all counties implement a sick-time policy and provide at least 56 hours of paid sick leave per year to their employees.  Paid sick leave shall accrue at the rate of one hour of paid sick leave for every 30 hours worked.  The bill places several other requirements on these sick leave policies.  While ACCG has no issue with whatever sick leave the state may elect to provide its employees, we believe that counties are best apt to make their own personnel decisions.

This bill provides that the state retirement system, as well as retirement plans offered by counties and other local governments, may include an option for use of a qualified Roth contribution program in a deferred compensation plan. As to counties, this appears to be a restatement or clarification of existing authority provided to counties under the Georgia Constitution.

 This legislation allows law enforcement to request those arrested who have significant exposure to HIV, Hepatitis B, or hepatitis C to have a blood test in order to protect their personal health.  If the arrestee refuses a judge may order the test be administered with the cost to be borne by the officer, arrestee, or the Department of Public Health.  The determination of payment for the test shall be made by the judge issuing the order.

This legislation creates the Local Law Enforcement Officer Compensation Commission to be housed within the Department of Administrative Services.  The Commission shall include a CEO of county or municipal corporation law enforcement agency, a sheriff , the Executive Directors of ACCG and GMA, two members of the Senate, and  two members of the House of Representatives, with the DOAS Commissioner serving as the chair.  The commission must meet at least semi-annually and provide on-going review of salaries and benefits using data required to be submitted by governing authorities.

This legislation requires employers, including counties, that offer sick leave to allow their employees to use up to five days of the sick leave, which must be earned, to care for immediate family members.  Nothing requires employers to offer sick leave to begin with and the employee must comply with the terms of the county's sick leave policy.  Nothing in this bill shall be construed to create a new cause of against the county.  This law sunsets on July 1, 2020.

This legislation applies the Federal Religious Restoration Act to the State of Georgia and counties.  The Federal Religious Restoration Act prohibits the government from substantially burdening a person's exercise of religious unless it is in furtherance of a compelling governmental interest and is the least restrictive means of furthering the compelling governmental interest.

This legislation requires counties to pay all deputies at the same level as the minimum annual salary for troopers of the Georgia State Patrol.  Each year, the deputies must recieve the same cost of living increase as state employees.  The legislation also creates a Local Law Enforcement Compensation Commission to study salaries and benefits of all local law enforcement officers.

In declaring English as Georgia's official language, this proposed Constitutional amendment, among other provisions, prohibits counties from adopting any law, ordinance, decree, program or policy using any other language for any official documents, regulations, orders, transactions, proceedings, meetings, programs or publications.  There are nine exceptions, particularly related to teaching English, public safety, crime victims and criminal defendants, and terms of art.  Any resident or anyone doing business in Georgia has standing to sue for injunctive relief for any violations of this provision.
