This legislation amends the Transit Authority Act. It broadens the definition of "metropolitan area" to include any city, regardless of population, and the suburban area around it. It also requires an intergovernmental agreement when a new transit authority is created in an area where another transit authority or county public transit provider is already in operation.

This legislation allows counties, when abandoning a road in a subdivision with a homeowners' association, to provide notice to the homeowners' association on the proposed abandonment, rather than the adjoining property owners. The homeowners' association could then exercise the option to buy the abandoned road back from the county.
This legislation was amended in committee to provide for all municipal corporations formed on or after April 15, 2005 to assume the ownership, control, care, and maintenance of county road rights of way within the municipal jurisdiction unless agreed to otherwise by joint agreement between the county and municipal corporation.
 
County Impact:  This legislation will make it easier for a county to dispose of and/or abandon a public road within a subdivision by only requiring notice to the homeowner's association.

This legislation allows farmers who are 16 years of age or older to drive all terrain vehicles and personal transportation vehicles (i.e., motorized vehicles with three or more wheels that can travel up to 20 miles per hour) on public roads to transport agricultural products, livestock, farm machinery or supplies to or from a farm. They may also be used on public roads to transport farmers who are 16 years old or older from their residence to the farm where they work. Cities may prohibit or limit the use of such vehicles on public roads within the city if it is determined that the use of the vehicles endangers the safety of the traveling public, however counties do not have the ability to limit use in unincorporated areas.

This legislation limits the liability of space flight entities offering space flights in Georgia.  Under HB 734, lost in space, flight, would also be the ability of counties and cities to adopt any noise control ordinances or otherwise prohibit the conduct of a space flight operation. Local governments would retain their authority over zoning, land use and rights of way.

This legislation changes the "commercial wrecker emergency tow permit," which currently allows heavy tow trucks to move disabled, damaged, abandoned or wrecked commercial vehicles, to a "commercial wrecker tow permit." The new permit now allows these large tow trucks to also tow a "replacement" commercial vehicle to the location of the commercial vehicle that is disabled, damaged or wrecked to replace the disabled, damaged or wrecked commercial vehicle.  No weight limits are increased.

This legislation started off helping the Atlanta Beltline finance itself by allowing for contracts between local governments and the private sector. Language which would have required local governments to pay for the relocation of utilities located in the public rights-of-way was removed in the conference committee report that passed. Local governments that have different white lining, marking or other utility locate procedures than the state Department of Transportation or Public Service Commission cannot impose fines on those failing to follow the local procedures.  The bill also extends, from 21 to 30 days, the time by which blasting or excavating must commence after providing notice.
