This was the omnibus gun bill of this year's session. ACCG opposed three of its numerous provisions: weapons being allowed in local government buildings unless security and screening are in place; law enforcement not being able to detain persons carrying weapons to determine whether they are legally licensed to do so; and individuals being empowered to sue a county, an elected official or a county employee for any perceived violation of state firearms regulations.

The underlying language for this bill was stripped in the Senate Non-Civil Judiciary Committee on Wednesday and was substituted with the language in SB 160. Both bills address one of ACCG's top priorities this session, which is to reduce paperwork and bureaucratic morass in complying with Georgia's illegal immigration reform mandates.

This legislation requires bars, massage parlors, truck stops, rest areas, airports, hotels, emergency rooms, urgent care centers, job recruitment centers, farm labor contractors and day haulers to post notices on a form developed by the Department of Safety regarding a hot line for victims of kidnapping, slavery and human trafficking. Law enforcement is required to notify any of the businesses who fail to post the required sign in writing that failure to correct the deficiency within 30 days is a misdemeanor punishable by a fine of up to $500. The legislation purports to exempt the costs of prosecution from taxes and additional penalties, fees or surcharges.

Counties may designate certain commercial areas (including up to a half-mile of contiguous residential property) with a high rate of drug related crimes as "drug-free commercial zones." A copy of the ordinance must be filed with the Department of Community Affairs (DCA), with a map and report.  This legislation would extend this felony designation to a drug crime occurring within a drug-free commercial zone adopted by a county and entered into DCA's registry on or before July 1, 2013.

This legislation was stripped and substituted with language that changes the required collateral for professional bonding companies.  Professional bonding companies that are new to a county or have operated continuously less than 18 months in the county must meet terms and conditions set by the sheriff.  Once a company has operated for 18 months or longer the cash escrow or other form of collateral shall not exceed 10 percent of the outstanding bail bond liability. This bill also prohibits bonding companies from purchasing insurance policies in lieu of establishing a cash escrow account or posting other collateral; provided however that bonding companies which had an insurance policy in place as collateral as of December 31, 2013 may continue to do so at the discretion of the sheriff.

This is omnibus gun carry legislation that lifts several current prohibitions on where concealed firearms may be carried.  It authorizes the carrying of weapons, by those with permits, in bars, churches and, importantly, in county government buildings that do not have security guards. ACCG is opposed to this provision in the bill. Please contact your Senators immediately to let them know any concerns you have.

In traffic cases where a fine is imposed that includes costs, courts may charge an additional $5 fee, known as the electronic citation fee, if the "governing authority of the court" has adopted a resolution imposing the fee. The fee must be placed in the Electronic Citation Fund. Each year, the court clerk must provide an annual report and accounting of the fund to the Georgia Superior Court Clerks Cooperative Authority and to each governing authority that approved the resolution imposing the electronic citation fee. The resolution sunsets at the end of each fiscal year and governing authority must adopt a resolution on an annual basis to impose the fee. The Sunset was changed from 5 years from 2019 to 2023.

This legislation creates the crime of cargo theft, which includes stealing a trailer or other equipment deployed or used by a law enforcement agency.  This bill amends the powers and duties of the Georgia Bureau of Investigation to include the indentification and investigation of these crimes in conjunction with local law enforcement.

This bill prohibits law enforcement agencies from posting booking photographs (other than of those on the sex offender registry) on a web site.  Furthermore, law enforcement is prohibited from providing these photographs to persons who place them in publications or post on web sites and who charge a fee for removing or deleting these photographs.

This is the omnibus gun carry bill of 2014. It was enhanced in the Senate Judiciary Non-Civil Committee to successfully address ACCG's three objections to the original bill. Specifically the substitute:

- allows local governments to determine whether or not guns are allowed in their government buildings, regardless of whether metal detectors or security screening is provided; 

- removes the provision prohibiting law enforcement from detaining persons illegally carrying guns without licenses; and

-removes the "private right of action" provision allowing any special interest group or individual (whether or not aggrieved) to sue counties and county officials statewide.

ACCG urges you to encourage your legislators to adopt the Senate version of HB 875 or adopt no version at all.

This legislation amends the Statewide Jury Act passed in 2010 to give oversight of the selection of grand jurors by the clerk from county master jury list to the presiding judge in consulation with the district attorney. This bill provides that prior to empaneling, swearing and charging the grand jury, the judge and the district attorney may examine prospective jurors as to their qualifications to serve. This eliminates the potential appointment of convicted felons to serve on grand juries.
