A violation of the prohibition constitutes a criminal felony and may also result in civil penalties. | This bill creates the 2011 Special Council on Criminal Justice Reform for Georgians to study Georgia's criminal justice and correction system to enhance public safety, reduce victimization, hold offenders more accountable, enhance probation and parole supervision and better manage a growing prison population. The Council would create a report of its findings and recommend legislation no later than January 9, 2012. The Council's recommendations would then be considered by a Special Joint Committee on Georgia Criminal Justice Reform. The joint committee would cause legislation to be introduced incorporating the recommendations without significant changes. |

| Under current law, the sheriff has the option of whether to allow private process servers to serve certain court papers in the county. To become a certified process server, a person must file an application with the sheriff. The sheriff has to approve a process server to operate in the county.
HB 284 removes the sheriff's authority to decide whether private process servers can serve papers in the county. The applications will now be handled by the Administrative Office of the Courts. |

HB 872 is a compromise bill which includes provisions from the Senate verison SB 321. This legislation requires secondary metal recyclers to obtain a permit from the sheriff every year. The sheriff is required to keep a record of all permits, the date of issuance, as well as the name and address of the permit holder. | This bill creates the Georgia Sheriffs' Cooperative Authority. The purpose of this authority is to serve as a cooperative for the development, acquisition and distribution of record management systems, information, public safety related databases, electronic monitoring of inmates and probationers, services, supplies and materials for sheriffs so that their offices can operate more cost efficiently. The authority is made up of seven members, including a member appointed by the executive board of ACCG. It also provides for the powers of the authority which includes the ability to contract with local governments for the use of any property, facilities or services. Additionally, it authorizes the authority to fix and collect fees and charges for data, media, and other services furnished to it by individuals or private entities, but such fees and charges are required be filed annually with the Secretary of the Senate and the Clerk of the House of Representatives and may require legislative approval. A similar bill was introduced in the Senate, SB 411. |

SB 296 also requires anyone wanting to transport or sell nonferrous metals to a secondary metals recycler to obtain a 1 year permit from the sheriff to transfer or sell the materials.

| SB 350 specifies that guns forfeited because of their use in the commission of a crime must be disposed of to the highest bidder once they are no longer of use to the law enforcement agency. Before disposing of the gun, law enforcement must try to find the rightful owner, if it is suspected that the gun may have been stolen. Guns that belong to innocent owners must be returned to those owners.
